THE CHALLENGE

“We have been paying the employee for years. Why would we need to pay again to end the employment?”

After eight years of employment, Echelon decided it was time to end its employment relationship with a China-based employee.

But the situation was not a straightforward termination.

For a significant period of time, the employee’s actual workload had become very limited. Despite this, Echelon had continued paying the employee’s regular salary.

From the company’s perspective, it had already supported the employee financially for a long period despite receiving very little work in return.

So when the possibility of termination was raised and Echelon learned that an employer-led exit could potentially trigger economic compensation obligations under Chinese labor law, the company faced a difficult question:

Why should we pay additional compensation after continuing to pay salary while very little work was being performed?

For Echelon, the issue was not simply the amount of money involved.

There were eight years of history behind the employment relationship.

The company believed it had treated the employee fairly throughout that period. At the same time, ending employment in China still required careful consideration of the legal basis, process, documentation, and any potential compensation obligations.

Taking an aggressive approach could turn a long-standing relationship into a labor dispute.

Simply paying compensation and closing the case without examining the circumstances would not address Echelon’s concerns either.

HROne needed to find a path that was legally appropriate while taking the realities of the relationship seriously.

THE SOUTION

HROne became the communication bridge between Echelon and the employee

HROne first helped Echelon understand that limited workload alone did not automatically remove the legal considerations attached to ending an eight-year employment relationship.

The team reviewed the situation from a compliance perspective and helped Echelon understand the available options before any action was taken.

But the legal analysis was only one part of the case.

The larger challenge was communication.

Echelon’s position was not simply that it did not want to pay compensation. Its frustration came from the history of the relationship: the company had continued supporting the employee financially during a prolonged period when relatively little work was being performed.

HROne helped communicate that context to the employee while also making sure the employee’s position was properly heard.

Rather than treating the situation as a negotiation in which one side had to win, HROne focused the conversations on the history of the employment relationship and whether both sides could reach an outcome they considered fair.

That changed the tone of the discussion.

The employee acknowledged how Echelon had treated them over the years, while Echelon avoided forcing an immediate or confrontational termination.

As discussions continued, the employee ultimately chose to resign voluntarily and did not pursue economic compensation from the company.

HROne then supported both sides in documenting and completing the separation appropriately.

THE RESULTS

An eight-year employment relationship ended without becoming an eight-year dispute

What initially appeared likely to become a difficult employer-led termination ultimately became a voluntary and peaceful separation.

There was no prolonged dispute over eight years of service.

There was no labor arbitration.

And the employment relationship did not end in confrontation.

For Echelon, the result was not simply about avoiding an additional employment cost. HROne helped the company prevent a difficult employee situation from developing into a larger legal, operational, and management issue.

The employee had the opportunity to understand the employer’s perspective rather than receiving an abrupt termination decision. Echelon, in turn, was able to close the relationship without taking an unnecessarily aggressive approach.

The case also reinforced a broader lesson about employee management: skills may determine whether someone can perform a role, but trust, honesty, and shared values often shape how an employment relationship develops over time — including how both sides behave when it comes to an end.

THE KEY OUTCOMES

· No economic compensation was ultimately claimed as part of the employee-led resignation
· Avoided a potentially prolonged labor dispute or arbitration process
· Reduced legal, financial, and management exposure for Echelon
· Preserved mutual respect between the employer and employee
“HROne helped us navigate a very sensitive employee situation in China with both professionalism and empathy. They did more than explain the legal requirements — they helped us communicate with the employee, understand our options, and reach an outcome that both sides could accept. What could have become a difficult dispute ultimately ended peacefully.”
