When the employer cancels or terminates the labor contract with the employee, if the employee fails to take the annual leave that should be taken in the current year, the number of days of annual leave that should be converted according to the working hours of the employee in the current year and the salary and remuneration of annual leave shall be paid.
However, the salary and remuneration of annual leave that is less than 1 day after conversion shall not be paid.
The conversion method is: (calendar days in the current year ÷ 365 days) × The number of days of annual leave that employees should enjoy throughout the year – the number of days of annual leave arranged in the current year.
