When the medical treatment expires and the labor contract is terminated, the employee can claim the medical subsidy if he/she is “being identified as grade 5-10 by the labor appraisal committee”. Generally, the employer does not need to pay medical subsidies after terminating the contract. If the employee is identified as grade 1-4, he/she will go through the formalities of retirement and resignation, and there is no need to pay the medical subsidy.
When the medical treatment expires and the labor contract is terminated, can the worker claim medical subsidy?
