13th Month Salary (13th Month Pay)

« Back to Glossary Index

What Is 13th Month Salary?

13th month salary is an additional payment on top of the usual 12 monthly salary payments, often made at year-end. The amount may equal one month’s base salary, but its calculation and timing depend on local rules and the employer’s actual agreement. The name alone does not establish a universal payment formula.

In China, employers sometimes call this an extra month’s salary or year-end double pay. It should be distinguished from a variable performance bonus, although either arrangement may be paid near the end of the year.

Is 13th Month Pay Mandatory in China?

There is no general nationwide requirement for every China employer to pay a 13th month salary. The Wuhan Municipal Government’s explanation distinguishes extra-month salary from performance-related year-end awards and confirms the absence of a universal statutory requirement.

A payment may nonetheless be owed when an employment contract, offer, valid compensation policy or established practice makes it an entitlement. HR should therefore check the actual terms before calling an extra salary payment voluntary.

13th Month Salary vs Annual Bonus

A guaranteed 13th month is commonly defined as a fixed extra salary amount. An annual bonus can instead depend on individual performance, company results or management discretion. Neither term automatically determines the worker’s legal entitlement: the compensation documents and actual practice matter.

An employee’s eligibility after joining partway through the year or leaving before payment depends on the applicable terms and facts. There is no single China statutory formula that makes every 13th month payment payable in full or automatically pro-rated.

How Does China Tax 13th Month Pay?

An extra salary payment is not tax-free. Employers must determine whether the amount is ordinary wage remuneration or qualifies for a particular annual one-time bonus treatment, based on applicable law and the payment’s real character.

Under Ministry of Finance and State Taxation Administration Announcement No. 30 of 2023, qualifying resident individuals can use the separate annual bonus IIT method through December 31, 2027, or include the eligible bonus in annual comprehensive income. Calling a payment “13th month salary” does not automatically establish qualification.

Where Can Employers Find Calculation Guidance?

Employers should record the payment basis, eligibility, payment date and treatment of salary changes or partial-year service. Payroll must apply the chosen agreement consistently while reviewing the separate tax question.

Whether an employee receives a 13th-month payment depends on the applicable agreement, policy and circumstances. The 13th-month pay rules in China also affect prorated payments, resignations and year-end payroll treatment.
