Representative Office Staff Hiring
According to Chinese law, representative offices are not permitted to directly hire employees in China. If a representative office needs staff, it should seek labor dispatch services from a certified Employer of Record (EOR) company like HROne.
Relevant Process
- The representative office confirms the candidates and compensation packages for the intended staff.
- The representative office and HROne sign a service agreement.
- HROne signs an employment contract with the candidates, making them EOR employees, and dispatches them to work at the representative office in compliance with Chinese law.
- During the employment period, the EOR employees work at the representative office, with HROne, as the legal employer, managing payroll, social insurance, and other statutory taxes. The representative office pays the total labor costs and service fees on a monthly basis as invoiced.
- During the employment period, the representative office can replace EOR employees at any time by notifying HROne in advance and paying the necessary fees, with HROne handling the rest of the process.
- When the representative office is closed, the service can be terminated by notifying HROne in advance as per the agreement and paying the required fees in compliance with the law. HROne will then manage the termination process with the EOR employees.
