Representative Office Staff Hiring

Under Chinese law, a representative office cannot directly hire employees in China. If a representative office needs staff, it should find an EOR company such as HROne, which is certified by the Chinese government, to provide labor dispatch services.

Key Processes of HROne Service

  1. The representative office confirms the candidates and offers of the staff to be hired.
  2. The representative office and HROne sign a service contract.
  3. HROne signs a legal required employment contract with the candidate, and the candidate becomes an EOR employee and is dispatched to work in a representative office in accordance with Chinese law.
  4. During the employment period, the EOR employee works in the representative office, and HROne is responsible for the employee’s salary, mandatory benefits and other statutory taxes as the employer, and the representative office pays the total labor cost and service fee according to the bill every month.
  5. During the employment period, the representative office can replace the EOR employee at any time, only need to notify HROne in advance and pay the relevant fees in accordance with the law, and HROne will be responsible for completing the process of new employee onboarding and replaced employee offboarding.
  6. When the representative office is deregistered, as long as HROne is notified in advance to terminate the service as agreed and the corresponding fee is paid in accordance with the law, the service can be terminated, and HROne will handle the subsequent dismissal with the EOR employees.
