Expatriate Employment

China is the world’s second largest economy, and there are many expatriates who live and work in China for a long time, who are familiar with the local Chinese culture and business rules, and have no language or cultural barriers with their home countries. They are a good business bridge between China and their home countries, and many home country companies are willing to hire them to represent them in their China affairs.

If these home companies happen to have their own subsidiaries in China, these subsidiaries can directly hire expatriates in China.

However, it is not necessary to set up a local subsidiary in China to handle China affairs. These home companies can engage a local Chinese company to hire these expatriates to handle China affairs.

Chinese law prohibits the use of EOR to hire expatriates, so if you wish to hire expatriates locally without setting up a Chinese subsidiary, you should talk to the HROne team to see if our subsidiary in China can take on your work in China and hire your designated expatriate to complete the work.

Key Processes of HROne Service

  1. The client submits expatriate information and business information in China.
  2. HROne’s Chinese subsidiary confirms whether its business scope allows it to undertake the project and whether the expatriate is eligible to obtain the appropriate work visa.
  3. After confirmation by HROne’s Chinese subsidiary, the client and HROne or its Chinese subsidiary sign a service contract or project contract.
  4. HROne’s China subsidiary signs a legal required employment contract with the candidate and issues a work visa for the candidate. The candidate becomes an expatriate employee of HROne’s Chinese subsidiary and is assigned to be responsible for the client’s project.
  5. During the employment period, the expatriate is responsible for the client’s affairs in China, and the client manages his/her work through HROne’s Chinese subsidiary. HROne’s China subsidiary is responsible for the payroll, mandatory benefits and other statutory taxes of the expatriate employees, and the client pays the project service fee on a monthly basis.
  6. When the client no longer needs the expatriate to work for them, as long as HROne is notified in advance to terminate the service as agreed and pays the corresponding fee in accordance with the law, the service can be terminated, and the Chinese subsidiary of HROne will handle the subsequent dismissal and cancellation of the work visa with the expatriate employee.
