Tax Incentives for Manufacturers in China: Eligibility Guide

Tax Incentives for Manufacturers in China Eligibility Guide

Tax incentives for manufacturers in China apply only when the mainland China taxpayer meets the conditions for a specific policy. Foreign ownership, operating a factory, exporting goods, registering in a free trade zone or using an Employer of Record does not create automatic eligibility.

The three incentives most relevant to many manufacturers are the 15% corporate income tax rate for recognized High and New Technology Enterprises, the R&D expense super deduction and the 5% advanced-manufacturing VAT additional credit. Each has a different claimant, qualification test, process and evidence file.

Start with the taxpayer, not the factory

The first question is which entity will claim the incentive. The claimant generally needs to be the mainland China taxpayer that conducts or records the activity, bears the costs, earns the revenue and files the relevant corporate income tax or VAT return. An overseas parent cannot assume that activity performed in China gives the parent access to an incentive claimed by a separate Chinese entity.

A foreign-invested manufacturer can qualify on the same policy basis as another eligible mainland enterprise, but foreign-invested status is not itself an incentive. The result depends on the China entity’s resident-enterprise status, certification, industry classification, revenue composition, R&D substance, VAT taxpayer status, current catalogues or annual lists, accounting records and local implementation.

IssueWhat it coversWhat it does not cover
Corporate income tax incentivesThe qualifying enterprise and its taxable incomeEmployee IIT, statutory contributions or another entity’s tax position
VAT incentivesThe qualifying VAT taxpayer and eligible input VAT or taxable transactionsEmployee payroll or a blanket cash refund for being a manufacturer
Payroll and employee taxSalary, IIT withholding, statutory contributions, payslips and employment-cost recordsAutomatic HNTE, R&D or advanced-manufacturing VAT eligibility

A reduced enterprise tax rate does not reduce an employee’s IIT rate or the employer’s labor-law obligations. HROne’s China payroll guide covers gross-to-net pay, employee deductions, employer contributions and payroll controls rather than CIT or VAT claims.

1. HNTE status can reduce the corporate income tax rate to 15%

The official HNTE tax guidance confirms a 15% CIT rate for state-supported high and new technology enterprises. It does not provide a 13% rate. A manufacturer must obtain valid HNTE recognition and continue meeting the conditions; describing a product as high-tech or holding several patents is not sufficient.

The criteria address mainland resident-enterprise registration, core IP, technology within supported fields, R&D and technical personnel, R&D expenditure ratios, high-tech revenue, innovation capability and specified compliance history. HROne’s guide to China high-tech enterprise qualification explains the framework in detail. The certificate is time-limited, annual records must continue to support the criteria, and benefits may be recovered if the entity is later found not to qualify.

2. The R&D super deduction is activity- and cost-specific

HNTE status is not a general prerequisite for the R&D super deduction. Under the official R&D super-deduction rules, an eligible resident enterprise may claim an additional deduction equal to 100% of qualifying R&D expense that is expensed, while a qualifying R&D intangible asset is amortized at 200% of cost.

The company must distinguish genuine R&D from routine production or commercial work. Routine upgrades, direct adoption of public research, post-commercialization support, simple changes, market or management research, routine quality control, testing, repair and maintenance do not qualify merely because engineers perform them.

Wages, statutory social insurance and housing fund contributions for personnel directly engaged in R&D may fall within the permitted personnel-cost category. Where an employee performs both R&D and non-R&D work, the company needs a reasonable allocation supported by activity evidence. Finance, R&D management and HR should reconcile the project roster, employment records, payroll, contributions, time or activity records and project-level R&D ledger. A payroll register proves payment; it does not prove qualifying R&D.

3. The advanced-manufacturing VAT credit is not available to every manufacturer

The advanced-manufacturing VAT announcement permits an eligible enterprise to calculate an additional credit equal to 5% of current deductible input VAT and use it against VAT payable. The statutory policy runs through December 31, 2027.

The claimant must be an HNTE, a manufacturing VAT general taxpayer and included on the applicable annual list. Annual notices can impose current-year tests involving industry classification, manufacturing revenue composition, HNTE metrics, tax history, application timing and local review. Do not reuse an old annual window or revenue test without checking the current notice; HNTE recognition, annual-list confirmation and VAT filing are separate procedures.

The calculation covers only deductible input VAT within the policy. Input VAT attributable to exports and cross-border taxable activities is excluded, and the enterprise must separately account for accruals, use, reductions and balances. If several VAT additional-credit policies could apply, the enterprise may choose the more favorable one but may not stack them for the same period.

Eligibility decision flow for a manufacturing entity

  1. Identify the claimant. Confirm the mainland China entity or branch that bears the cost, records the revenue and files the relevant CIT or VAT return.
  2. Map the activity. Reconcile registration, industry classification, products, production model, outsourced processing and revenue streams with actual operations.
  3. Screen each incentive separately. HNTE recognition, the R&D super deduction and the advanced-manufacturing VAT credit do not share one eligibility test.
  4. Check current status. Confirm certificate validity, supported fields or catalogues, current annual lists, VAT status, revenue tests and local instructions.
  5. Test the evidence. Link technical projects, IP, personnel, payroll, costs, invoices, revenue and VAT records to the same entity and period.
  6. Quantify after eligibility. Model the effect using the entity’s actual taxable position; do not book a guaranteed saving from a headline percentage.
  7. Use the correct process. Certification, CIT filing and retained records, and annual-list/VAT procedures are separate workflows.
  8. Obtain professional review. A qualified PRC tax adviser should confirm eligibility, calculation, filing treatment and current local implementation.

What does not create automatic eligibility?

AssumptionCorrect employer position
The shareholder is foreign or the business uses an EORForeign ownership does not grant the incentive, and an EOR client does not inherit the provider’s CIT or VAT status. The mainland claimant and its own evidence must qualify.
The business operates in an FTZFTZ registration alone does not provide a reduced CIT rate. Any regional treatment depends on the specific zone, industry, activity, substance and current policy.
The factory employs engineers or an R&D teamOnly qualifying activities and correctly attributed costs enter the R&D calculation; engineering, quality and production work is not automatically R&D.
The company exports manufactured goodsExport VAT treatment depends on current policy, customs commodity code, applicable rate, export date, transaction model and documents. It is not a blanket manufacturer benefit.
The entity holds an HNTE certificateThe certificate does not remove annual evidence requirements or automatically place the entity on every advanced-manufacturing list.

The current export VAT policy framework confirms that export refund rates are administered through the official rate library and can depend on the export date and classification. Review export VAT separately from the three incentives compared here.

Documentation and record-retention checklist

China’s CIT preferential-treatment administration rules generally use a self-assessment, filing and retained-document model for CIT incentives. The enterprise is responsible for its evidence, should organize separate files by incentive or project and must generally retain CIT preferential-treatment records for 10 years from the day after the relevant annual CIT settlement period ends.

  • Entity and tax status: registration records, tax status, VAT general-taxpayer status, branch structure and current business scope.
  • HNTE qualification: certificate, recognition file, IP, supported-technology mapping, innovation assessment, high-tech product or service descriptions and annual eligibility support.
  • R&D technical file: project approval, technical uncertainty, methodology, milestones, experiments, tests, design changes, failed work and results.
  • Personnel and payroll: roster, job descriptions, contracts, payroll, statutory contributions, activity allocation and project-assignment approval.
  • R&D cost accounting: auxiliary ledgers, general-ledger reconciliation, invoices, materials, equipment and depreciation, intangible assets, outsourced R&D and allocation methods.
  • Revenue classification: products, contracts, invoices, high-tech revenue, manufacturing revenue, outsourced-processing treatment and return reconciliation.
  • VAT evidence: current annual-list confirmation, input invoices, eligible and excluded input ledger, export and cross-border exclusions, adjustments and VAT returns.
  • Claim file: calculations, return schedules, approvals, adviser memoranda, authority correspondence and corrections.

Finance and tax should own the filing and reconciliation; R&D or engineering should own technical evidence; HR and payroll should own personnel and compensation records; legal should support IP, contracts and entity structure; and a qualified PRC tax adviser should confirm the current policy and claim. Payroll data supports the file but cannot determine technical R&D status or authorize a CIT or VAT position.

How HROne supports workforce and payroll evidence

HROne is not a corporate tax adviser and does not determine or file manufacturer CIT or VAT incentive claims. For an entity that directly employs staff in China, HROne’s China payroll outsourcing service can support consistent payroll registers, employee-cost data, IIT withholding records, statutory contribution records, payslips and employee documentation for the company and its qualified tax adviser to review.

Before relying on payroll data in an HNTE or R&D file, request a payroll-record readiness review and have the PRC tax adviser confirm which personnel costs, allocation method and supporting records are acceptable for the intended claim.

Frequently asked questions

What are the main tax incentives for manufacturers in China?

Commonly relevant incentives include the 15% CIT rate for a recognized HNTE, the R&D expense super deduction and the 5% advanced-manufacturing VAT additional credit. They are separate policies. A manufacturer must meet each policy’s entity, activity, certification, accounting, annual-list and evidence conditions before claiming it.

Does a foreign-owned manufacturer or EOR client qualify automatically?

No. Foreign ownership, factory operations or use of an EOR does not create eligibility. The qualifying mainland China taxpayer must meet the conditions and hold the required records. An EOR client does not inherit the provider’s entity-level CIT or VAT status.

Does the R&D super deduction require HNTE status?

No. The R&D super deduction has its own eligibility rules and can apply to an eligible resident enterprise without HNTE recognition. The company must conduct qualifying R&D, segregate eligible expenses accurately and retain project-level technical and financial evidence.

Is the advanced-manufacturing VAT credit the same as an export VAT refund?

No. The advanced-manufacturing policy provides an additional credit equal to 5% of eligible deductible input VAT for a qualifying listed enterprise. Export VAT refund or exemption treatment is a separate system based on current policy, commodity codes, rates, export dates, transaction structure and documents.

How long should manufacturer tax-incentive records be retained?

For CIT preferential treatment, the official administration rules generally require supporting records to be kept for 10 years from the day after the relevant annual CIT settlement period ends. The company should also apply any longer or separate accounting, VAT, certification and local requirements and keep records organized by incentive and project.
